Intimate Image Removal

Falue LLC ("Falue," "we," "us," or "our") prohibits the nonconsensualdistribution of intimate images and certain digitally created or manipulatedintimate depictions.

This Policy explains how individuals can request removal of qualifyingintimate content from Falue, including requests that may qualify under thefederal TAKE IT DOWN Act.

This process is separate from Falue's ordinary content-reporting andcopyright processes because intimate-content reports may involve specializedsafety and legal requirements.

1. What This Policy Covers

You may use this process when you believe Falue contains an intimate visualdepiction of you or another identifiable individual that was publishedwithout the depicted person's consent and is prohibited by applicable law orFalue policy.

Qualifying material may include:

• Nonconsensually shared nude photographs;
• Nonconsensually shared sexually explicit photographs or videos;
• Intimate material originally created consensually but later distributed without consent;
• Secretly recorded intimate imagery;
• Stolen or unlawfully obtained intimate imagery;
• Certain AI-generated intimate depictions;
• Sexual deepfakes;
• Digitally altered intimate depictions; and
• Other intimate visual depictions covered by applicable law or Falue policy.

2. Consent to Create Is Not Necessarily Consent to Share

A person may consent to the creation of an intimate image without consentingto its publication or distribution on Falue.

A person may also consent to sharing an intimate image with one person orwithin one context without consenting to its distribution to a wideraudience.

Falue may therefore take action even where the depicted person originallycreated or voluntarily provided the image.

3. AI-Generated and Digitally Manipulated Images

This Policy may apply even when an intimate depiction is not an authenticphotograph or video.

Falue prohibits qualifying nonconsensual intimate depictions created ormodified using:

• Artificial intelligence;
• Generative AI;
• Deepfake technology;
• Face replacement;
• Image compositing;
• Digital manipulation; or
• Other synthetic-media technology.

The fact that an image is "fake" does not automatically make it acceptable onFalue.

4. Who May Submit a Request

A removal request may be submitted by the identifiable individual depictedin the material or, where permitted by applicable law, an authorized personacting on that individual's behalf.

Additional rules may apply when the depicted person is a minor, deceased,incapacitated, or otherwise unable to submit the request personally.

Falue may request information reasonably necessary to verify that a requesteris authorized to make the request.

5. How to Request Removal

Falue may also provide an in-app or web-based reporting form for theserequests.

6. Information to Include

To help Falue locate and evaluate the material, provide as much of thefollowing information as reasonably available:

• Your name and contact information;
• The name of the person depicted, if you are acting on their behalf;
• The Falue username or account that posted the material, if known;
• A direct link or other identifier for the content;
• A description sufficient to identify the material;
• A statement explaining that the depicted individual did not consent to the publication or distribution at issue;
• Whether the depiction is authentic, digitally altered, or AI-generated, if known;
• Any other information reasonably necessary to locate the material; and
• Any statements or attestations required by applicable law.

Do not send additional intimate images to Falue unless specifically necessaryand requested through an appropriate secure reporting process.

7. Required Statements for Qualifying Legal Notices

Where a request is submitted under the TAKE IT DOWN Act or another law thatrequires particular statements, Falue may require the requester to providethe legally required information and attestations.

This may include a good-faith statement that the identified materialconstitutes a qualifying intimate depiction of the individual and waspublished without the individual's consent, together with informationsufficient to identify and locate the content.

Falue may provide a structured reporting form to collect the informationrequired by applicable law.

8. What Happens After a Request Is Submitted

Falue may review the request to determine whether the identified contentviolates Falue policy or qualifies for removal under applicable law.

Falue may:

• Locate and review the reported content;
• Request additional information;
• Remove or disable access to the content;
• Restrict distribution while a matter is reviewed;
• Take action against the account responsible;
• Preserve relevant records;
• Search for known identical copies where required or appropriate;
• Apply technical measures intended to reduce re-uploading where available and lawful; or
• Take other safety or legal action appropriate to the circumstances.

9. Qualifying TAKE IT DOWN Requests

For a valid request that qualifies under the federal TAKE IT DOWN Act, Faluewill remove or disable access to the covered intimate depiction as requiredby applicable law.

Where the Act requires action within 48 hours after receipt of a validrequest, Falue will process the qualifying request within that legallyrequired period.

Falue will also make reasonable efforts concerning known identical copieswhere required by applicable law.

The 48-hour requirement applies to requests that satisfy the applicable legalrequirements. Reports that do not contain enough information to identify thecontent or satisfy required legal elements may require additionalinformation.

10. Falue May Act Faster

Nothing in this Policy prevents Falue from removing content before theexpiration of a legally applicable deadline.

Where the violation is clear or presents a serious safety concern, Falue maytake immediate action.

11. Minors

Sexual or intimate imagery involving minors is treated with heightenedseriousness.

Child sexual abuse material ("CSAM") is strictly prohibited on Falue.

Do not download, save, screenshot, forward, email, or otherwise redistributesuspected CSAM in an attempt to report it.

Instead, report the account or content through Falue's safety tools and, whereappropriate, contact an authorized child-safety organization orlaw-enforcement authority.

Falue may preserve information and report apparent child sexual exploitationor abuse to appropriate organizations or authorities where required orpermitted by law.

12. Sextortion and Threats to Release Intimate Content

Falue prohibits using intimate material or the threat of intimate material toblackmail, extort, coerce, threaten, or control another person.

This includes demanding:

• Money;
• Additional photographs or videos;
• Sexual activity;
• Continued communication;
• Account credentials;
• Other property; or
• Anything else of value

in exchange for not releasing intimate material.

Report sextortion or threats to Falue immediately. If you are in immediatephysical danger, contact the appropriate emergency or law-enforcementauthority.

13. Re-Uploads and Identical Copies

Removing one post may not always prevent another person from attempting toupload the same material again.

Where required by law or reasonably appropriate, Falue may use availabletechnical measures and other information to identify known identical copiesof material that has been determined to violate this Policy.

Falue may remove or disable access to those copies without requiring theaffected individual to submit a completely new report for every knownidentical copy where applicable.

14. Altered Copies

A person may attempt to circumvent removal by cropping, resizing, filtering,adding text to, mirroring, or otherwise modifying prohibited intimatematerial.

Falue may treat substantially similar altered versions as violations whenappropriate under Falue policy or applicable law.

15. Account Enforcement

Posting or distributing nonconsensual intimate imagery may result in accountenforcement.

Depending on severity and circumstances, Falue may:

• Remove the content;
• Restrict the account;
• Disable messaging or sharing features;
• Temporarily suspend the account;
• Permanently disable the account;
• Prevent creation of replacement accounts;
• Preserve relevant evidence;
• Report conduct where required or permitted by law; or
• Take other appropriate safety measures.

Severe violations may result in immediate permanent account action without aprior warning.

16. Privacy of the Requester

Falue will limit access to intimate-content removal requests to people andsystems that reasonably need the information for safety, review, legal,security, operational, or enforcement purposes.

We do not ordinarily disclose a requester's identity to the reported usermerely because an intimate-content report was submitted.

However, information may be disclosed where required by law, valid legalprocess, or where otherwise legally necessary.

17. Protecting Sensitive Information

Falue recognizes that intimate-content reports may contain highly sensitiveinformation.

Requesters should provide only the information reasonably necessary toidentify themselves where required, establish the request, and allow Falue tolocate the material.

Falue may implement additional safeguards or restricted-access procedures forthese reports.

18. Preservation of Evidence

Removing content from public view does not necessarily mean that all copiesare immediately erased from Falue's systems.

Falue may preserve content and associated records when reasonably necessaryfor:

• Legal compliance;
• Law-enforcement requests;
• Safety investigations;
• Evidence preservation;
• Fraud or abuse prevention;
• Enforcement;
• Appeals;
• Litigation or legal claims; or
• Other legitimate purposes permitted by law.

Preserved material will not remain publicly accessible merely because it isretained for one of these purposes.

19. False or Abusive Requests

Do not knowingly submit a false or fraudulent intimate-content removalrequest.

Falue may take appropriate action where someone intentionally uses thisprocess to:

• Remove lawful content through deception;
• Harass another person;
• Impersonate the depicted person;
• Submit fabricated evidence;
• Suppress content unrelated to intimate imagery; or
• Otherwise abuse Falue's safety systems.

Nothing in this section is intended to discourage good-faith reports.

20. Appeals and Mistakes

Falue recognizes that mistakes can occur.

Where appropriate, a user whose content is removed may be permitted torequest review of the decision.

An appeal does not guarantee restoration.

Falue may decline to restore material when another independent legal, safety,privacy, or Community Guidelines basis requires or permits the material toremain unavailable.

21. Copyright Claims Are Different

An intimate image may also be copyrighted, but copyright ownership andconsent to intimate-image distribution are different legal issues.

You do not need to own the copyright in a qualifying intimate depiction inorder to use an intimate-image removal process when applicable law gives youthat right.

Copyright complaints should be submitted separately through Falue'sCopyright DMCA process where appropriate.

22. Law Enforcement

Falue may preserve or disclose information in response to valid legal processor other circumstances where disclosure is required or permitted by law.

Falue may also respond to qualifying emergency requests involving imminentdanger of death or serious physical injury where legally permitted.

23. Falue Is Not an Emergency Service

Submitting a Falue report is not a substitute for contacting emergencyservices.

If you or another person is in immediate physical danger, contact theappropriate local emergency or law-enforcement authority.

24. Other Falue Policies Still Apply

Content may violate more than one Falue policy.

For example, nonconsensual intimate imagery may also involve harassment,impersonation, threats, child exploitation, copyright infringement, privacyviolations, or other prohibited conduct.

Falue may take action under any applicable policy.

25. Changes to This Policy

Falue may update this Policy to reflect changes to applicable law, theServices, reporting systems, safety technologies, or Falue's policies.

When appropriate, Falue may provide notice of material changes. The date atthe top identifies the current version.

If Falue provides a dedicated online removal form, we may direct requeststhrough that form to improve security, privacy, and processing speed.
